These Terms and Conditions ("Terms", "T&Cs") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "user", "customer") and Rafelitos ("we", "us", or "our"), concerning your access to and use of our website located in Anchorage, Alaska.

By accessing or using our website and ordering platform, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms, you are expressly prohibited from using the site and must discontinue use immediately.

The information and explanations provided on this website are for general informational and ordering purposes only. While we strive to maintain accurate menu items, pricing, and restaurant policies, the materials on this site do not constitute legal, financial, or professional advice.

2. Eligibility & Authorized Use

To use this website or place an order, you must be at least 18 years of age, or the age of majority in your jurisdiction, and possess the legal authority to enter into these Terms. If you are ordering alcoholic beverages (such as Micheladas), you strictly represent and warrant that you are at least 21 years of age and will present a valid government-issued photo ID at the time of pickup.

3. Service Model: Pickup Only

Rafelitos operates strictly on a pickup-only basis.

  • We do not provide, manage, or guarantee delivery services through this website.

  • All orders placed online must be picked up by the customer at our designated location in Anchorage, Alaska during regular business hours.

  • It is the customer's sole responsibility to pick up their order in a timely manner. Rafelitos is not responsible for food quality degradation, cooling, or spoilage if an order is picked up late.

4. Payments, Pricing, & Right to Modify Offerings

  • Payment Methods: We accept major credit cards and electronic payment methods as specified at the checkout screen. You agree to provide current, complete, and accurate purchase information for all orders.

  • Pricing Changes: Prices for our menu items are subject to change without notice.

  • Right to Modify: We reserve the right at any time to modify, suspend, or discontinue any menu item, service, or portion of the website without prior notice. We shall not be liable to you or to any third party for any modification, price change, or discontinuance of the Service.

5. Order Cancellation & Refund Policy

Because our food is freshly prepared to order:

  • Once an order is accepted and preparation begins, it cannot be canceled, and no refunds will be issued.

  • If there is an error with your pickup order, please notify our staff immediately at the counter so we can correct it.

6. Intellectual Property & Copyright

The website and its entire contents, features, and functionality (including but not limited to the Rafelitos brand name, logo, images of food, text, graphics, and software) are owned by Rafelitos and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or modify any content from this site without our express written permission.

7. Account Suspension or Termination

If our website permits the creation of customer accounts, we reserve the sole right to terminate or suspend your account, or refuse service and access to the website, at any time, without prior notice or liability, for any reason—including if you breach these Terms and Conditions.

8. Guarantees & Limitation of Liability

  • Guarantees: We prepare our food in accordance with local Anchorage health department standards. However, our website and online ordering system are provided on an "AS IS" and "AS AVAILABLE" basis without guarantees of any kind, either express or implied.

  • Limitation of Liability: To the maximum extent permitted by law, Rafelitos, its owners, and employees shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the website, delayed pickups, or inability to access the online menu.

9. Governing Law & Jurisdiction

These Terms and Conditions and your use of the website are governed by and construed in accordance with the laws of the State of Alaska, without regard to its conflict of law principles. Any legal action arising under these terms must be brought in the courts located in Anchorage, Alaska.

10. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page with a revised "Last Updated" date. Your continued use of the site after changes are posted constitutes your acceptance of the new Terms.
